Reported the University's position in a suit involving Patrick Kycia's drowning after leaving a party at the Phi Sigma Kappa fraternity house. Patrick had a blood alcohol level of 0.17 and friends said he drank heavily at the party. An attorney for Minnesota State University Moorhead argued that the school should be dropped from the wrongful death lawsuit because it has no control over what happens off campus and because students at the school are adults and responsible for their own behavior.  Also argued was the fact that the school did not own the fraternity house, therefore was not responsible. The fraternity houes is directly across the street from the school.

Reported that Patrick's Julian Kycia said he is happy to see so many people hauled into court  actions that he believes helped kill his son.  The charges stem from a party at the Phi Sigma Kappa fraternity where Patrick Kycia was seen drinking the night he went missing.  Julian Kycia said he hopes every parent will make the message clear to their kids: If they throw a party and something goes wrong, they could be charged with a felony.

Reported that Minnesota State University Moorhead was dismissed from a lawsuit stemming from Patrick's death.  In the decision, the Court said central to the question of MSUM’s liability was whether the university is immune from suits under a law that bars claims against state entities if a loss is caused by performing or failure to perform a discretionary duty.
